What was accomplished?
Thanks to a bill introduced by Representative Joel Fry, it eliminated reference to a monthly fiscal cap for Home and Community Based Services in the Brain Injury Waiver.
Why is this important?
- The prior language read: “The total cost of brain injury waiver services, excluding the cost of case management and home and vehicle modifications, shall not exceed $3,013.08 per month.”
- This language was obsolete within the current managed care environment.
- $3,013 was never reflective of actual costs under the brain injury waiver.
- Prior to Managed Care, the Iowa Department of Human Services managed brain injury costs in excess of this “cap” through an “exception to policy” system.
- However, the Managed Care companies regularly restricts services to this artificial “cap”.

I am not yet on the brain injury waiver program. I am quickly paying out
the money from a trust to pay my rent. It will be depleted in a couple of months.
Will I be able to apply for the brain injury waiver program?
Hi Laurie, this is a great question, it is also complex. Would you be able to give us a call so one of our Neuro Resource Facilitators can get some additional information in order to assist you? You can call at 1-855-444-6443 or email at info@biaia.org
